ALSO, THEY NEED TO BE REGISTED WITH OFR, WHICH THEY ARE NOT. IF THEY HAVE COLLECTED AN ADVANCE FEE OR RETAINER FROM YOU PLEASE FILE A COMPLAINT WITH THE FLORIDA ATTORNEY GENERAL AND THE OFFICE OF FINANCIAL REGULATIONS. Effective January 2010, the Florida Legislature placed the primary enforcement authority regarding loan modification businesses, INCLUDING THE PROHIBITIONS ON ADVANCE FEES. See Chapter 494, Section 494.00296, Florida Statutes. The provisions of Chapter 494 and Section 501.1377, Florida Statutes, passed in 2008, prohibit advance fees and other deceptive practices by loan modification businesses.
