We hired PFG understanding the service they provided was to custom tailor our financial portfolio to fit within the lenders required guidelines in order to qualify for a modification. The first step of the process was for PFG to review our financial docs. in order to determine if they could guarantee a modification; on 2/09, they verbally assured us they would be able to get us a loan modification & also verbally stated that if we were dissatisfied with any part of their services we would receive a full refund of the modification process fee of $2K. On 3/ 11/09, we signed the agreement based on the terms mentioned above. During the 22 mo. period, we have not received any indication of a loan modification plan, my spouse was laid off 9 mo. ago, we pleaded & begged for updates with a sense of urgency on our status, & provided countless copies of our financial doc. Mr. De La Garza, continues to ignore our requests for updates and lacks any type of response after his personal assurance of providing us immediate attention to our case with a sense of urgency was promised in a personal email. Lastly, without us knowing, HUD put out a statement in 3/09, that no loan modification company should be accepting initial payment of any kind to conduct a modification process (this could be considered a retainer). We have requested a full refund in writing because we realize that PFG has not fulfilled our expectations of their services. No response has been received which would be typical from Mr. De La Garza. We have filed a small claims against PFG and Mr. De La Garza. Do not use this company. It is apparent that they do not care if their clients complain or recieve law suits which I believe will soon follow after HUD and California DRE investigate their practice.
