Why are they allowed to stay in business?***
I bought a car whose engine was rebuilt at this shop 3 months ago. The motor has less than 1000 miles on the rebuilt engine. The head gasket is leaking and the timing chain is making noise.
I brought it back for warranty service, but the manager/owner is refusing to cover it under warranty because the warranty is "not transferable."
This is despite the fact:
1. The engine was messed up before I bought it (the car ran, temps were normal, and I didn't know gasket was leaking, and i thought the engine was
just loud)
2. The engine has less than 1,000 miles since it's been rebuilt.
3. Rebuilt engines should last at least 100,000 miles.
4. The car is still registered and titled to the previous owner.
The car having less than 1000 miles since it was rebuilt, didn't even get to see a single service before I bought it. (It had been sitting most of the time because the driver of the car is/was pregnant)
I did all basic maintenance on the car (tires, brakes, topped fluids, oil change) when I purchased it, and a few days later it died on me on the freeway.
Alternator went out, power steering was leaking (i was told about this before I bought it) and I had those fixed at a well respected shop in Orange County.
After fixing the alternator they tried to start up the car and it was hesitant to start. While diagnosing the issue, they removed one of the spark plugs and noticed water in one of the cylinders indicating a bad head gasket. They also noted the timing chain was noisy. When they contacted me of the issue, I told them to only fix the external issues (non-engine related) of the car and had it towed to Planet Engine afterwards.
The first thing the Planet Engine shop manager said to me when I got the car towed in, and told him of the situation was that the warranty is NOT transferable despite the conditions and that "it was going to cost me some money."
This all happened yesterday (2/4/11). I will remove, update and edit this post as necessary. I have yet to contact the previous owner but I have a feeling the shop is going to be less than cooperative in honoring their warranty.
If this does not get resolved by next week this is the course of action I plan to take:
1. File complaints with BBB, San Bernardino County, and Bureau of Automotive Repair.
2. File additional reviews on Yelp, Google, and Yellowpages
3. Get the car towed and fixed elsewhere (where I trust their work) and then file a small claims suit for the balance of the repair on the grounds that the engine should be covered under warranty because it came defective from the previous owner.
If you are also having problems or had problems with this shop involving warranty work please send me a message. If I have to file a small claims, I'll help you file a claim (if it's a legitimate case) on the grounds that you are also willing to follow steps 1,2, and 3 above and I will do it free of charge.
I guarantee you there is power with numbers and if there is enough complaints with their fraudulent warranty we might be able to get their BAR license revoked.
