On 04/03/2012 consumer purchased a 2000 Jeep Grand Cherokee. A few days later the engine failed partly due to her negligence. When the check gauges light came on, she continued to drive the car until the engine quit running. At the time of sale she was given a warranty which covered this failure and also covered some rental car coverage. Protective Warranty #99900015084. She also signed a buyer’s guide showing seller to pay 0% parts and 0% labor. She also declined the contract cancellation option. Protective Warranty has agreed to honor the warranty. I agree this process took longer than expected, because engine had to be disassembled to point of failure and an inspector had to come and inspect the engine. It took a few days for Protective to make a decision, then an engine had to be located and sent. The engine was sent to Texas by mistake. As far as we would not communicate with her is a downright lie, she called at least 3 times a day demanding to unwind the contract, demanded another car, etc. She called Premier Auto Electric, who is replacing the engine, several times a day. She even called my home at night yelling at me and went so far as seeking out one of the technicians home address and visiting him at night and on the weekend. I was willing to let her purchase another car, the only car she would look at was double the price and she needed terms close to the ones she already had, She was very upset when I couldn't help her. She purchased her Grand Cherokee for $7963.00. After two days of negotiation, I purchase her Jeep for $7671.34. This difference is less than the $500.00 it would have cost her if she had purchased the contract cancellation option. When I purchased the Jeep from her she assured me she was now happy, and had already purchase another car, and I would not hear from her again. Even though this was an unfortunate situation for her, I did not ignore her and I don't know what I could have done differently.
Nikki Smith did not prevail after two law suits in the small claims court, and did not prevail with the Better Business Bureau, She is trying to get paid $5000.00 for her inconvenience. Machinery fails, if it didn't there would be no warranties on new cars or need for repair shops Nikki had a warranty which repaired her car without hastle, but did not pay for her inconvenience.
