I sued ACS for breach of contract and poor workmanship regarding a solar pool heating system and won a major settlement in 2010 (Los Angeles Superior Court, Case Number 10S01071, judgment entered 10/29/2010). My complaint included descriptions, pictures, videos, and repair estimates for 20 different system and installation deficiencies. My complaint also showed ACS failed to meet acceptable workmanship standards even after repeated attempts to correct the original deficiencies.
ACS appealed the original settlement, and the case was elevated to Los Angeles County Superior Court. Superior Court upheld the lower court decision on 12/28/2010, ruling against ACS yet again. However, ACS has yet to pay the judgement as ordered by the court 3 months ago. Therefore, I have filed an "Order to Produce Statement of Assets and to Appear for Examination," with a court date set for 04/13/2011. This action has resulted in additional court filing and process service fees which ACS is fully liable for. In addition, I am claiming interest as allowed by California state law at 10% per annum, dating back to 12/28/2010. If ACS does not appear in court on 04/13/2011, pay the court-ordered judgment, and pay the additional filing fees and interest, an arrest warrant will be issued for Mr Stephen Jenkins (Advanced Conservation Systems owner), and additional actions will be taken to enforce payment. I strongly recommend anyone considering a business relationship with ACS to reconsider all available options (there are several solar system businesses servicing the Antelope Valley), and choose wisely.
